Terms and Conditions

1. The Platform’s Role
“Open Filmmaking” acts solely as a venue and marketplace for filmmakers to post project listings and for talent to apply for roles. We are not an employer, agent, or representative of any party. We do not vet the accuracy, quality, or legitimacy of project listings or applicants. You acknowledge that your interactions are strictly between you and the other party.

2. Responsibilities of Filmmakers
Binding Commitments: By posting a project, you affirm that the compensation offered (whether monetary, points, or percentages) is a firm, binding commitment.

Any promise of future ‘points’ or ‘back-end percentages’ constitutes a legally binding contract between the Filmmaker and the Talent.

Payment & Fulfillment: You are legally responsible for paying talent exactly what was promised in your project listing. Failure to fulfill these commitments may result in permanent removal from our platform.

Accuracy: You are solely responsible for the information provided in your project description.

3. Moderation & Approval
All project listings are subject to review by our team. We reserve the right to approve, reject, or remove any project at our sole discretion.

Guidelines: Projects containing explicit, illegal, or harassing content are strictly prohibited and will be rejected.

Timeline: Please allow up to 48 hours for project approval. A project is not considered “live” until it has been manually reviewed and approved by our team.

4. Payments, Fees & Refund Policy
Listing Fee: The fee paid to post a project is for the service of hosting your listing on our platform.

Non-Refundable: All listing fees are final and non-refundable once the payment is processed, regardless of whether you choose to remove your project early, fail to find talent, or if your project is canceled.

Exceptions: If your project is rejected by our team for failing to meet community guidelines, a refund may be issued at our sole discretion.

5. Limitation of Liability & Disputes
No Platform Responsibility: We are not responsible for any disputes, damages, or losses arising from interactions between filmmakers and talent. This includes, but is not limited to: failure to pay promised compensation, failure to show up for shoots, project delays, or artistic disputes.

Independent Resolution: You agree to resolve any disputes directly with the other party. “Open Filmmaking” will not mediate, intervene, or participate in the resolution of private disputes.

6. Changes to These Terms
We reserve the right to modify these Terms of Service at any time, at our sole discretion. Any changes will be effective immediately upon posting to the platform. Your continued use of the platform after such changes constitutes your acceptance of the new Terms of Service. It is your responsibility to review these terms periodically for updates.

7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Ireland. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland.
